Terms and Conditions

Calgary Process Serving & Investigations Inc. provides process serving, courthouse filing, Mobile Commissioner for Oaths (Calgary & Area), and related legal support services to lawyers, law firms, companies, and private individuals across Canada and the U.S.
By hiring Calgary Process Serving & Investigations Inc., you agree to and accept all terms outlined on this website and in our correspondence.

Commissioner vs. Notary
Mobile Commissioner for Oaths services are valid only for documents used within Alberta. Notary Public services are offered solely in connection with our business, as permitted under section 4(1) of the Notaries and Commissioners Act. Documents for use outside Alberta may require a notary or further authentication.


Services for Canadian Law Firms

  • Documents may be mailed or couriered with clear written instructions.

  • Upon completion, we provide an Affidavit of Service or Attempted Service and an invoice.

  • Courthouse filings are offered; acceptance, amendments, and rejections are at the discretion of court clerks. We are not responsible for rejected or deficient filings.


Services for U.S. Law Firms

  • Service in Alberta is conducted in accordance with the Hague Service Convention.

  • We comply with Article 10 (service via competent persons/private process servers).

  • Include a blank affidavit of service with your documents; we will complete and commission it (or notarize where permitted under s.4(1)).

  • Original affidavits can be returned by courier at cost.


Services for Private Companies & Individuals

  • Payment in full is required before services begin.

  • If additional work is required (extra attempts, mileage, tracing, courier), we will obtain your approval before proceeding and issue an additional invoice.

  • U.S. clients must include a blank affidavit of service for compliance with court requirements.


Code of Conduct

  • We maintain professionalism and expect the same from clients.

  • We may refuse or terminate service if a client behaves in a threatening, aggressive, or unprofessional manner.

  • Fees for services already commenced remain payable.

  • Unpaid accounts may be sent to collections; related costs are the client’s responsibility.


Payment Terms

  1. Canadian Law Firms – Payment due upon receipt. $50 late fee applies after 30 days and each subsequent month.

  2. Private Companies & Individuals – Payment in full before services start.

  3. Chargebacks will be sent to collections; affidavits will be withheld until payment is received.

  4. No Refunds – Once work begins, all fees are non-refundable.


Service Details

  • Rush/Priority Service: 1–3 business days.

  • Regular Service: 3–10 business days.

  • Flat-fee services include:

    • Up to three attempts at service.

    • Affidavit of Service or Attempted Service.

    • Commissioning/notarizing of the affidavit.

    • Electronic copy and original sent via Canada Post regular mail.

  • Extra attempts and services incur additional fees.

  • Mileage applies to services outside city limits.

  • Multiple services at the same address/file incur additional affidavit fees per person.

  • Courier and registered mail billed at cost.

  • Court filing services subject to applicable court fees.

  • Clients must inform us if the party is evading service so proper measures can be taken.


Privacy, Confidentiality & Limitation of Responsibility

Calgary Process Serving & Investigations Inc. is committed to protecting the privacy and confidentiality of all clients, recipients, and parties involved in service. All information provided to us is used solely for the purpose of effecting service, preparing affidavits, and completing related legal tasks, and is handled in accordance with applicable privacy legislation.

We do not disclose client identities, file contents, instructions, or personal information to third parties except as required to complete lawful service, prepare court documents, or comply with a legal obligation.

Limitation of Responsibility:
Calgary Process Serving & Investigations Inc. is responsible only for the lawful and professional execution of service in accordance with client instructions and applicable law. We are not responsible or liable for any actions, reactions, communications, emotional responses, disputes, threats, harassment, or conduct of any party before, during, or after service is completed, including but not limited to contact initiated between parties as a result of service.

Once documents are lawfully served or service is lawfully attempted, any subsequent interactions between the parties are outside our control and responsibility. We do not monitor, manage, intervene in, or assume responsibility for interpersonal conflicts, domestic disputes, or communications that may arise following service.

Clients acknowledge that service of legal documents may cause emotional or personal reactions, and agree that Calgary Process Serving & Investigations Inc. bears no liability for consequences arising from lawful service beyond the act of service itself.

We rely on the accuracy of the information you provide. Errors, omissions, or changes may cause delays and result in extra fees.

Effective January 1, 2024. We reserve the right to amend these terms without prior notice.
